The state Supreme Court says Majority Republicans in the Legislature are able to appeal a federal ruling that extends the deadline for counting absentee ballots.
GOP lawmakers are asking the full 7th Circuit Court of Appeals to review an earlier decision. It lets clerks count absentee ballots, if they arrive up to six days after the election and are postmarked by Election Day.
The federal appeals court asked the state Supreme Court if the Legislature can represent the state’s interest in the case. The Supreme Court ruling was 4-3.
The 7th Circuit will have to decide whether to review the case.
