GREEN BAY, Wis. — A mistrial is declared in the case of a Green Bay teenager accused of setting a fatal fire.
A Brown County jury is deadlocked after more than six hours of deliberation in the case of Marcelia Fonseca, who was charged with First Degree Intentional Homicide and Arson.
The jury was given approval Thursday morning to consider a lesser charge of felony murder, but it could not reach a unanimous decision.
Prosecutors allege Fonseca set fire to the bedroom of her infant nephew — leading to his death — in June of 2019. The defense claims the fire was accidental and caused by faulty wiring in the house.
A status hearing is scheduled for Dec. 12.
