The Wisconsin Supreme Court will not offer any guidance to clerks in Outagamie County on how to handle misprinted ballots.
The County filed an emergency petition with the court this week asking it to decide how to fix ballots that cannot be counted by machine on election night.
County Clerk Lori O’Bright says state statutes only allow for the ballots to be re-created in their entirety on another form.
Local clerks want to save time and avoid errors by only correcting the small timing mark on the form so the machine can read it.
All parties fear that having to recreate ballots by hand will cause the county to miss its results reporting deadline of 4:00 Wednesday afternoon.
