APPLETON, Wis – -An Outagamie County Judge rules the Town of Buchanan’s transportation utility fee is illegal. The town adopted the fee in 2019 to fund its road construction and improvement projects. The fee applied to all developed properties in the township.
Wisconsin Property Taxpayers, Incorporated filed suit against the transportation utility fee with the aid of the Wisconsin Institute for Law and Liberty. They contended that the fee was illegal since the township was already at its levy limit of $2.4 million last year.
Outagamie County Circuit Court Judge Mark McGinnis agreed, ruling that the Town of Buchanan’s transportation utility fee violates the state’s levy limits.
