The police charge of – Assault with a Deadly Implement – could apply to a variety of objects but I’ll bet not many times has it specifically meant a construction excavator.
The long arm of the law just met the longer arm of an excavator and we’ll score this battle a push.
Dash cam video (courtesy of the Vermont State Police) shows officers arriving at the home of 24-year-old Brandon Tallman, who was wanted on assault and burglary charges. As they attempt to arrest Brandon, his mother tries to pull him away from police. Then, to make it a true family affair, Brandon’s father shows up – wielding an excavator as a weapon – and according to the police report, “attempted to assault the officers with the construction equipment.” The father threatened the officers with the bucket, then relented after a gun was drawn and a warning was issued by one of the officers.
Ultimately, police arrested all three of them (did they impound the excavator as evidence?) and there were no injuries.
